Cozy Title Unpacking Developers Request Nintendo to Eliminate “Egregious Scams” from eShop

Witch Beam, the studio behind the acclaimed indie game Unpacking, has formally requested that Nintendo take action against several counterfeit games available on the Switch eShop. These imitation titles, mimicking both names and designs, have been accused of misleading customers into purchasing subpar products, prompting a broader discussion about Nintendo’s commitment to ensuring quality control and protecting intellectual property on its platform.

The Australian game developer has highlighted specific titles on the eShop that closely resemble their game, including a notable example: Unpacking: Universe Dreams, released by CGI Lab. According to a report from Eurogamer, Witch Beam describes these copycat titles as “egregious scams” designed to exploit the success of Unpacking and infringe on its trademark rights. Furthermore, it was pointed out that Nintendo has not responded to Witch Beam’s complaints over the past two weeks, allowing these deceptive games to remain listed on the eShop. A similar situation in 2022 resulted in the removal of a fraudulent game from both iOS and Google Play stores.

It’s been over two weeks and these are still on the eShop. Nintendo hasn’t responded to any of our reports of these egregious scams which are using our trademarked game name and purposely tricking Nintendo customers into buying cheap fakes.— Wren Brier (@wrenegade.bsky.social)2024-12-16T05:55:21.046Z

This situation has sparked extensive dialogue among users on platforms like BlueSky. Notably, Bobby Jack raised a critical point: “If it were a fan game that lovingly celebrated some Nintendo IP, it would be gone in a heartbeat…”This criticism underscores the perceived inconsistency in Nintendo’s enforcement policies regarding intellectual property. Some users, such as Tiny Newt, have also expressed frustration over not receiving refunds for their purchases of these fraudulent titles.

The ongoing episode illustrates the challenges faced by independent developers like Witch Beam in safeguarding their creations on extensive digital marketplaces. The delay in Nintendo’s response might inadvertently encourage the proliferation of such knockoffs, which not only undermine trust but can also deter legitimate developers from releasing their offerings on the eShop.

Many fans express mixed emotions about the situation. While competition in the gaming industry is generally welcomed, this case appears exploitative rather than competitive. The knockoff titles often mimic the original game’s naming convention, adding phrases like “Unpacking: [Subtitle]” to mislead customers. User Chalkitdownn shares sentiments echoed across various comments: “They won’t though… It’s been like this since, what, 2018? The eStore is so awful. I wish Nintendo actually cared.”

While it might be unfair to claim that Nintendo is apathetic, the issue of counterfeit products has plagued the industry for centuries, impacting numerous online storefronts. The description of the fraudulent Unpacking: Deluxe Edition raises eyebrows, as it misleadingly states, “This all-in-one package includes the main game alongside all previously released DLC.” It remains uncertain how Nintendo will proceed in resolving this matter, but it highlights the persistent challenges and the need for improved oversight within the Nintendo eShop.
